These Terms of Service govern your access to and use of Tikke. By downloading, installing, accessing, or using the app, you agree to be bound by these Terms and by any additional policies or notices that may be presented within the app. If you do not agree, you must not use Tikke.
Your use of the app constitutes a legally binding agreement between you and the operator of Tikke. If you use the app on behalf of another person or entity, you represent that you have authority to accept these Terms on their behalf.
You are responsible for all content, information, and materials you create, upload, import, store, export, or otherwise provide through Tikke, including photos, event names, band names, venue details, notes, tags, favorites, and personal reflections. You are solely responsible for ensuring that your content is accurate, lawful, and does not violate the rights of any third party.
You are also responsible for maintaining the security of your device, managing permissions you grant to the app, reviewing records before saving or exporting them, and backing up any information you consider important. If your content includes images of other people or materials taken at live events, you are responsible for using such content in compliance with applicable law, venue rules, and the rights of others.
Tikke is provided on an "as available" basis. We do not guarantee that the app will always be available, error-free, secure, or uninterrupted. Features may change over time, and some functions may depend on device compatibility, operating system support, Apple services, storage availability, permissions, or other factors outside our control.
We reserve the right, at any time and without liability, to modify, update, suspend, discontinue, or limit any part of the app, including free features, premium outputs, export options, or virtual currency functionality.
You may not use Tikke in any unlawful, abusive, fraudulent, or harmful manner. Prohibited conduct includes, without limitation: violating applicable laws or regulations; infringing intellectual property, privacy, publicity, or other rights; uploading malicious code; interfering with the app's operation; attempting unauthorized access to systems or data; reverse engineering, decompiling, disassembling, or attempting to derive source code except where prohibited by law; scraping or using automated bots; bypassing purchase flows, feature gates, or technical limitations; and using the app to distribute spam, harassment, threats, obscene material, or harmful content.
You may not use Tikke as a ticketing service, resale marketplace, public review platform, piracy tool, music streaming service, or content extraction system. The app is intended as a personal record-keeping tool, not as a channel for unauthorized distribution of copyrighted works or commercial exploitation of event-related content.
Tikke may automatically generate summaries, archive views, timelines, monthly recaps, memory cards, premium reports, or other formatted outputs based on the information you provide. These outputs are generated through automated processes and are intended for personal informational and organizational use only.
We do not guarantee that any generated result will be complete, accurate, properly categorized, aesthetically satisfactory, or suitable for any specific purpose. Dates, labels, summaries, and other generated elements may depend on user-entered data, device metadata, or system processing. You use and rely on generated results at your own risk.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TIKKE IS PROVIDED "AS IS," "AS AVAILABLE," AND "WITH ALL FAULTS." WE DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, QUIET ENJOYMENT, ACCURACY, RELIABILITY, OR THAT THE SERVICE WILL MEET YOUR EXPECTATIONS.
We do not warrant that the app will preserve data without loss, that exported cards will always save successfully, that purchases will always process correctly, or that the app will be free from bugs, delays, interruptions, or security vulnerabilities.
You must be at least 17 years old to use Tikke. By using the app, you represent and warrant that you are 17 or older and that you have the legal capacity to enter into this agreement under the laws applicable to you.
If you do not meet these requirements, you may not access or use the app. We may restrict or terminate access if we reasonably believe a user does not satisfy the eligibility standards.
Tikke may offer consumable virtual currency in the form of coins through Apple in-app purchases. Coins may be used to generate enhanced outputs such as premium live reports, gig memory cards, or monthly review cards. Coin prices, package sizes, promotional offers, and coin consumption amounts may change at any time, subject to applicable platform rules.
Coins are licensed, not sold, have no cash value, are not redeemable for money, are non-transferable, and may only be used within Tikke as expressly permitted. Unless required by applicable law or Apple platform policy, all purchases are final and non-refundable. Free trial uses or promotional credits, if offered, may be limited, modified, or discontinued at any time.
You acknowledge that Apple may process billing, authentication, and purchase validation. We are not responsible for delays, errors, refusals, or reversals caused by Apple, your payment method provider, or platform restrictions.
You agree to defend, indemnify, and hold harmless the operator of Tikke and its affiliates, service providers, contractors, licensors, and representatives from and against any claims, demands, actions, liabilities, damages, losses, judgments, settlements, costs, and expenses, including reasonable legal fees, arising out of or related to: your use or misuse of the app; your content; your violation of these Terms; your infringement of any third-party rights; or your violation of any law, regulation, or venue rule.
This obligation survives your cessation of use of the app and any termination of these Terms.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE OPERATOR OF TIKKE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, USE, BUSINESS OPPORTUNITY, OR DEVICE CONTENT, ARISING OUT OF OR RELATED TO THE APP OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
To the fullest extent allowed by law, our total liability for any claim arising from or related to Tikke shall not exceed the greater of: (a) the amount you paid, if any, for use of the app or in-app purchases during the twelve months before the event giving rise to the claim; or (b) USD $10. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
We may revise these Terms from time to time to reflect changes in the app, legal requirements, business practices, or platform rules. Updated Terms may be posted within the app, on an associated listing, or otherwise made available to users.
Your continued use of Tikke after updated Terms become effective means you accept the revised Terms. If you do not agree to a change, you must stop using the app.
Subject to your compliance with these Terms, you are granted a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use Tikke on compatible devices that you own or control, solely for your personal, non-commercial use.
No rights are granted except those expressly stated. You may not lease, sell, sublicense, distribute, publicly display, commercially exploit, or otherwise make the app available to others except as allowed by applicable law or platform terms.
Tikke, including its software, design, interface, branding, text, graphics, layout, compilations, functionality, and all related intellectual property rights, is owned by or licensed to the operator of Tikke and is protected by applicable intellectual property and unfair competition laws.
Except for the limited use rights granted in these Terms, you receive no ownership interest in the app or its components. All trademarks, service marks, logos, and product names associated with Tikke remain the property of their respective owners. Unauthorized use of any protected material is prohibited.
Tikke is a lightweight personal show-recording and memory organization app designed for users who attend live shows, small music festival stages, club performances, and similar events. The service allows users to capture or upload a single live-event photo, add an event title, band information, venue information, date, tags, favorite markers, and personal reflections, and save these details as a private record.
The app may present saved entries as live snapshots, personal archives, reverse-chronological timelines, band collections, venue records, and monthly summaries. Users may edit saved details, search and filter records by title, band, venue, year, tag, or favorite status, duplicate summaries, delete records, and export selected visual cards to their photo library. Certain enhanced outputs, such as premium live reports, memory cards, or monthly card formats, may require consumable coins obtained through Apple in-app purchases, while core recording and archive functions remain available without such purchases.
Tikke is intended as a personal memory and organization tool only. It is not a ticket marketplace, booking service, resale platform, public review community, social ranking system, music streaming product, lyric database, video distribution service, or copyrighted content aggregation tool. The app does not provide ticket purchasing, seat inventory, event payment processing, unauthorized audio capture, public live streaming, lyric copying, or scraping of protected music or album content.
Permissions such as camera access, photo library access, and photo library add access are requested only when needed for user-initiated actions like taking a photo, importing an image, or saving an exported card. Based on the described product model, user records, notes, tags, band and venue aggregations, and similar materials are generally processed and stored locally on the user's device, and exported cards are saved only when the user chooses to do so. Nevertheless, device behavior, operating system handling, and Apple purchase systems may affect how some data is stored or processed.
Photos and user-entered records may contain information about real events, real venues, or other individuals. Tikke does not promise to verify event details, authenticate tickets, identify people in images, perform facial recognition, infer identity, or determine legal rights associated with any uploaded material. The usefulness of the service depends substantially on the quality and legality of the content provided by the user.
We may suspend, restrict, disable, or terminate your access to Tikke at any time, with or without notice, if we believe you have violated these Terms, created risk or potential legal exposure, engaged in misuse, interfered with the app, or if continued operation of the service is no longer feasible.
You may stop using Tikke at any time. Termination or discontinuation does not relieve you of obligations accrued before termination, including payment obligations, indemnity duties, and restrictions regarding intellectual property and misuse.
You retain ownership of the photos, notes, tags, event details, and other content you provide to Tikke. We do not claim ownership of your user content. However, by using the app, you grant a limited, non-exclusive, revocable license to host, cache, copy, format, adapt, display, and otherwise process your content only as reasonably necessary to operate the app's features for you, such as saving records, generating views, creating exports, synchronizing app state where applicable, preventing abuse, and complying with legal obligations.
This license is limited to the operation of Tikke and does not transfer ownership of your content to us. You represent that you have all rights necessary to submit and use your content in the app, and that such content does not violate laws or the rights of others.
These Terms shall be governed by and construed in accordance with the applicable laws of the jurisdiction in which enforcement is sought, without regard to conflict of laws principles, except to the extent superseded by mandatory consumer protection laws or other non-waivable legal requirements.
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect to the extent permitted by law.
